13:28-3.4 Prohibited products

(a) No licensee, licensed premise or school of cosmetology and hairstyling shall utilize any product that contains methyl methacrylate monomer.

(b) Any violations of the provisions of this section shall constitute a deviation from the normal standards of practice required of a licensee, licensed premise or school of cosmetology and hairstyling, and shall subject a licensee, licensed premise or school of cosmetology and hairstyling to the penalties of N.J.S.A. 45:1-25.

Licensed cosmetologists, estheticians, and manicurists shall not use or possess in a shop any of the following products:
(1) Methyl Methacrylate Liquid Monomer a.k.a. MMA; and
(2) Razor-type callus shavers designed and intended to cut growths of skin such as corns and calluses.

NEW YORK STATE SENATE
INTRODUCER'S MEMORANDUM IN SUPPORT
submitted in accordance with Senate Rule VI. Sec 1

                                 CHAPTER 247
 
  AN  ACT  to amend the general business law, in relation to the sale, use
    and  application  of  monomeric  methyl  methacrylate  by   appearance
    enhancement businesses
 
     Became a law September 5, 2001, with the approval of the Governor.
            Passed by a majority vote, three-fifths being present.
 
    The  People of the State of New York, represented in Senate and Assem-
  bly, do enact as follows:
 
    Section 1. The general business law is amended by adding a new section
  404-a to read as follows:
    § 404-a. Monomeric methyl methacrylate.  1. No owner or operator of an
  appearance enhancement business shall knowingly and willfully:
    a. sell, use or apply to any person monomeric methyl methacrylate; or
    b. direct any agent or employee of such business to sell, use or apply
  to any person monomeric methyl methacrylate.
    2. A first violation of this section shall be punishable  by  a  civil
  penalty    of not more than one thousand dollars. A second or any subse-
  quent violation of this section shall be a class B misdemeanor.
    § 2. This act shall take effect on the  first  day  of  November  next
  succeeding the date on which it shall have become a law.

    Pursuant  to  the authority vested in us by section 70-b of the Public
  Officers Law, we hereby jointly certify that  this  slip  copy  of  this

Massachusetts

Please be advised that the Massachusetts Board of Cosmetology, as of 6/22/99, considers the use of Methyl Methacrylate Monomers (MMA) in the manicuring industry to be unsafe and therefore prohibited. These products are commonly referred to as "dental acrylics" or "porcelain nails". The FDA has classified MMA as a "poisonous and deleterious substance". MMA complaints have included skin allergies, permanent loss of the nail plate, permanent loss of sensation in the fingertips, and, after prolonged usage, permanent damage to the respiratory system.

The following tips for use in detecting MMA are published courtesy of Nailco™.

  1. An unusually strong or strange odor which doesn’t smell like other acrylic liquids.
  2. Enhancements that are extremely hard and very difficult to file even with course abrasives.
  3. Enhancements that will not soak off in solvents designed to remove acrylics.
